My office primarily represents clientele in commercial and business litigations, where the matter or the transaction that come up in the litigation vary widely but the type of dispute tends to be based on different types of disputes that come up frequently: fraud, breach of contract, reliance of misleading or bad faith representations, business disputes of all kinds. The kind of legal representation requires knowledge about legal procedures that apply to litigations, as well as substantive legal knowledge about issues in dispute.
In general, the procedure for litigation is similar in all courts in all jurisdictions, but the ability to comply with legal procedures and to do so efficiently so that legal disputes can be resolved is a genuine specialty that many lawyers who primarily do transactions are not adept at handling, or mastering. That said, a lawyer who can take a business dispute to the Courthouse is frequently an excellent lawyer to do the original documentation on business transactions to avoid litigation, and to insure that the transaction the closed in contract papers is the one you thought it was. There is an expertise that litigating lawyers possess which demonstrates how important it can be to rely on a good attorney to insure that your business enterprise is properly structured and your contracts are drafted in such a way that they protect you against future contingencies. Working with an attorney in advance of a transaction or in connection with the formation of a new enterprise can put you in the best position to avoid future problems and to minimize the risks of the kind of catastrophe that can come about when you start doing business without getting good legal advice. The later costs of a complex litigation to recover financial losses does not compare favorably with the costs of a good advance legal consultation.
